Throughout the history, crime and punishment has long been a controversial issue. People have different views regarding to whether punishment for each type of crime should be fixed or not. Although there are some advantages of fixed punishment, it seems to me that it is better to sentence based on the specific circumstance and one's motivation. There are some good arguments in favor of having one set punishment for each crime. Some people hold the view that it simplifies the proceeding procdure, which means that similiar crimes can be put into the same codes, making it easier to judge ceiminals, What's more, an identical punishment may reduce the crime rate, thus making contribution to the social stability. Since everyone is aware of the punishment of each crime, they won't run the risk of commiting a crime by reconsidering the consequences of this behavor. On the other hand, some people have different views. They argue that all types of crime must be investgated by taking all the internal and external factors in consideration, which is a prerequisite for establishing a fair and just system. A particular god example here is that someone who steals to feed the family and the other who steals for profit. In such circumstance, it would be unfair to penalize them in the same way for their sheer different motivations. On balance, even though fixed pupnishments can be extremely benecifial in the decrease of crime rate and simpler pcocedding procedures, I tend to believe that it is more desirable to decide the penalty on a case-by-case basis.
