It would be closer to the sense of: > We did soemething and we can still get in serious trouble for it. (There's still a risk) However the sentence refers to something you are in the process of doing or about to do, rather than some action in the past.

We are in the process of doing something and could (later) get into trouble for it. Also possible, we just completed doing something and we could get in serious trouble if it were discovered.
