This is very old fashioned contractual language, a style which is hard to follow and hard to correct. I would suggest starting again and writing it in plainer English; is this not possible?

Check it for what? It's not really English in the normal sense, as you suggest in the title. . Difficult enough to know what it should mean if correct. . Seems to state a purpose. I do wonder, though, how do you count nonperformances, as you can get another 5% for each new one that you identify.
