Fofa is right but the question would need to changed slightly, instead of "Who is the guilty?" you would either say: Who is the guilty party/person? or Who is guilty?

yes correct you are the guilty. you are the guilty person. you are guilty. the guilty is you if you say the guilty are you, i think this makes no sense.
