Abstract This Works presents the international migration problem in the modern society, addressing the historicity of the migratory effect and demonstrating that this is a process that takes place since the beginnings of humanity, explaining the migration’s path until it reaches the present day. Are exposed the refugees's rights listed in the Convention Relating to the Status of Refugees of 1951 and the rights concerning to the International Bill of Human Rights, highlighting articles that demonstrate the essence of protection and support given to those who need refuge. Elucidates the current context of migration in the European Union, requiring the incentive of tolerant and humanitarian policies, aiming at to protection of those already are refugees against discriminative and xenophobic acts, and together to this is indispensable to develop joint policies, aiming to act at the source of the problem for the reduction of European’s migration .
