No, they are not. They are simple statements of fact, not hypothetical or imagined situations. "He would not have done it deliberately" makes a straightforward statement. It would be subjunctive mood had you made (subjunctive!) it hypothetical: "Had he done it deliberately, things would have turned out worse" in which the first part of the sentence is subjunctive mood.
