"I'm by the pool"/"I'm in the pool" - what's the difference?
Does "I'm by the pool" mean that I'm near the pool but not in the water? Or that can mean either (either in the pool or near the pool)?

The difference is in your actual location, just as you've stated.
Being by the pool means that you're somewhere near the pool, while being in the pool means that you are actually in the pool.

Yes, "I'm by the pool" means the same thing as "I'm near the pool (but not in the water)."
