Refugees benefit from legal protections defined by the United Nations Refugee Convention of 1951. Unlike migrants, they are protected from return to their countries of origin, have the right to work and education, and cannot be punished for irregular entry once refugee status is granted.
But is this framework still workable in 2026?
The UN convention relies on the idea of a “well-founded fear of persecution”. How should that be tested, how far should it extend, and who carries the burden of proof? Are states required to provide protection to everyone who meets the criteria, or can limits be justified?
In this class, we analyse definitions, incentives, state obligations, and long-term sustainability of the current system of sheltering refugees.
