There is a slight difference. Don't be/get funny with me= don't try to fool me Example: Teacher: Why didn't you bring your homework today? Student: The dog ate it. Teacher: Don't get funny with me, I don't believe you .

Fresh with me Someone who is cocky, arrogant and a flirt. One can be accused of being Fresh or trying to get get Fresh with someone. Yea man pretty much. "Being fresh" usually implies defiance. Another phrase with very similar meaning is "Don't get smart with me."
