Generally, in the first case the question has already been asked, in the second case it has not yet been.

They are very similar. The first sentence to me sounds more immediate and concrete. Like they are talking about something that will actually happen. The second sentence sounds more hypothetical, like they are discussing some idea that will not actually take place in real life.

Not quite. Would is used if there is conditional aspect. There is an implied 'if'.
