2) If you have not got bad marks. >> In second variant I suppose we don't have any evidance related to present, so we can't use it, right?Is that a wrong test?

In the first one, grammatically both are correct. 1 implies that he would still do it today whereas in 2 it might late in the evening and he would've done it earlier. You could also add 'to' to the end of the sentence.
In the second one only 1 is correct. In 2 you would need to use 'will' instead of 'would'.
