Meaning of a phrase
What does the phrase "public capacity" mean in this sentence?:
"As ex head of state he cannot be sued in respect of acts performed whilst head of state in his public capacity."

What they mean is his capacity as a public figure, that is to say, as a person who is part of the government.
They are saying he cannot be judged for acts commited while he was a head of state.
